Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the LynxTrac platform (“Platform”) owned and operated by Pixbots Private Limited (“Company”, “we”, “us”, or “our”).
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Definitions

For the purposes of these Terms:

  • “Account” means the registered profile created by the User to access the Platform.

  • “User” / “You” means an individual or entity accessing or using the Platform.

  • “Device” means any server, workstation, virtual machine, or endpoint added to the Platform for monitoring.

  • “Data” includes metrics, logs, configurations, alert history, dashboards, and any other information generated or stored by the Platform.

  • “Paid Plan” means any subscription tier that requires payment.

  • “Free Plan” means any subscription tier offered at no cost.

  • “Inactivity” means no login activity for thirty (30) consecutive days.

2. Eligibility

You must be at least 18 years old or authorized by your organization to create an account.
Businesses must ensure that the person accepting these Terms is duly authorized.

3. Account Registration

You agree to:

  • provide accurate and current information during registration;

  • maintain confidentiality of your login credentials;

  • notify us immediately of unauthorized access;

  • be responsible for all actions performed under your Account.

We may refuse registration or terminate existing Accounts at our discretion.

4. License and Access Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal business or personal use.

You agree not to:

  • copy, modify, distribute, or reverse-engineer any part of the Platform;

  • bypass security controls or attempt unauthorized access;

  • use the Platform to violate any law or rights of third parties.

5. Subscription Plans and Payment Terms

  • Access to certain features requires a Paid Plan.

  • Subscription fees are billed according to the selected billing cycle.

  • All fees are non-refundable unless required by applicable law.

  • Failure to pay may result in suspension or termination of your Account.

  • Taxes, duties, and other government fees are your responsibility.

We may modify pricing, provided we give reasonable advance notice.

6. Service Level & Availability

We strive to maintain continuous Platform availability but do not guarantee uninterrupted operation.
Maintenance, upgrades, or unforeseen technical issues may cause temporary downtime.
We are not liable for any losses resulting from service interruptions.

7. Customer Data & Privacy

You retain ownership of the Data you upload or generate.
By using the Platform, you grant us the rights necessary to store, process, and transmit your Data for the purpose of providing services.

We maintain technical and organizational measures to protect Data but cannot guarantee absolute security.

8. Data Retention, Account Inactivity & Device Cleanup

8.1 Inactivity Definition

Your Account is deemed Inactive if you do not log in for thirty (30) consecutive days.

8.2 Device Deactivation for Inactive Accounts

Upon becoming Inactive, we may deactivate all Devices associated with your Account.
Deactivation may include suspension of:

  • monitoring,

  • data collection,

  • alerting,

  • dashboard access.

Deactivation does not immediately delete devices or data.

8.3 Notice Prior to Deletion

We will provide 7 days’ prior notice before permanently deleting any Devices or Data.
Notice will be sent to your registered email and/or via in-app notifications.

8.4 Permanent Deletion After Extended Inactivity

If you do not log in within the notice period (total 37 days of inactivity):

  • Devices may be permanently deleted.

  • Associated Data (metrics, logs, alert history, dashboards) may be permanently deleted.
    Deleted data cannot be recovered.

8.5 Exceptions for Active Paid Accounts

Devices and data for Accounts on an active Paid Plan will not be deleted solely due to inactivity.
Monitoring may still be suspended under exceptional security or operational conditions.

8.6 Retention Limits by Plan

All Data is subject to the retention and storage limits defined by your subscription plan.
Data exceeding retention limits may be automatically archived or removed.

8.7 User Responsibility

It is your responsibility to log in periodically to avoid unintended deletion.
We are not liable for any data loss resulting from inactivity cleanup performed under these Terms.

9. Acceptable Use Policy

You agree not to use the Platform to:

  • commit illegal acts;

  • upload harmful or malicious content;

  • interfere with service integrity;

  • violate privacy or intellectual property rights;

  • perform security probing, scanning, or load testing without written permission.

10. Intellectual Property

All intellectual property rights in the Platform belong to Pixbots Private Limited or its licensors.
No rights are granted except those expressly stated in these Terms.

11. Third-Party Integrations

The Platform may integrate with third-party software or services.
Your use of such services is governed by their respective terms, and we are not responsible for their reliability or behavior.

12. Indemnification

You agree to indemnify and hold harmless Pixbots Private Limited, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

  • your misuse of the Platform,

  • your violation of these Terms,

  • your infringement of third-party rights.

13. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied.
We disclaim all warranties, including:

  • merchantability,

  • fitness for a particular purpose,

  • non-infringement.

We do not guarantee that the Platform will be error-free, secure, or uninterrupted.

14. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, punitive, or consequential damages, including loss of data, profits, or business.

  • Our total aggregate liability shall not exceed the fees paid by you in the preceding three (3) months.

  • Free Plan users acknowledge that the service is provided without warranty and with limited obligations.

15. Termination

We may suspend or terminate your Account immediately if you violate these Terms.
You may terminate your subscription at any time via account settings.
Upon termination, access to paid features stops immediately, and data may be deleted per retention policies.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India.
Any disputes shall be resolved exclusively in the courts located within India.

For enterprise customers, optional arbitration clauses can be added upon request.

17. Changes to Terms

We may update or modify these Terms at any time.
Changes will become effective upon posting.
Continued use of the Platform constitutes acceptance of updated Terms.
