This End User License Agreement ("Agreement") governs the LynxTrac software you install on a device: the LynxTrac Agent for Windows, macOS and Linux, and the LynxTrac Remote Viewer for Windows (together, the "Software"). The Software is licensed, not sold, by Pixbots Private Limited ("we", "us"). By installing the Software, or by accepting this Agreement in an installer, you agree to these terms.
Your use of the LynxTrac service itself, including accounts, subscriptions and the web console, is governed by our Terms & Conditions. If a conflict arises between the two on a question about the service, the Terms & Conditions apply.
1. License grant
While your LynxTrac account is in good standing, we grant you a non-exclusive, non-transferable, revocable licence to install and use the Software on the devices registered to your organization's account, for that organization's internal business purposes. Managed service providers may install it on the devices of customers they manage, provided they hold the authority described in section 3.
2. What the Software installs
The Agent installs background services that run with system privileges so it can monitor and manage the device. On Windows these are the LynxTrac Agent, Core, Engine and Updater services, together with a security monitoring service. Two components are optional and are only installed if you select them: log analytics, and a virtual display driver for headless VMs and VPS hosts. The Remote Viewer installs a desktop application.
The Agent updates itself automatically so that devices stay on a supported, patched version. Updates are covered by this Agreement.
3. Authority to install
You may install the Software only on devices you own or are authorised to administer. The Agent can give operators remote access to a device, including the screen and files, and it reports device activity to your LynxTrac account. You are responsible for having the rights and consents that your local law requires before installing it, and for telling the people who use those devices what is monitored. We are not responsible for installations made without that authority.
4. Restrictions
You may not:
- Sell, rent, sublicense or redistribute the Software outside the licence in section 1.
- Reverse engineer, decompile or disassemble the Software, except to the extent that applicable law expressly permits it despite this restriction, and except for components licensed to you under an open-source licence that grants those rights (see section 7).
- Remove or alter product identification, copyright or licence notices.
- Work around licensing limits, device counts or access controls.
- Use the Software in breach of our Acceptable Use policy.
5. Data
The Agent sends device, performance, security and inventory information to your LynxTrac account so the service can display and act on it. Our Privacy Policy explains how we handle personal data, and the Mobile App Privacy Policy covers the mobile apps.
6. Ownership
We and our licensors retain all rights, title and interest in the Software. This Agreement transfers no ownership.
7. Third-party components
LynxTrac is proprietary software. Nothing in this Agreement places any part of it under an open-source licence, and no licence to our source code is granted.
The Software bundles a number of components supplied by third parties, such as a security monitoring agent, a log shipper and a virtual display driver. Each of those keeps its own licence terms, which govern that component and, where they give you rights broader than this Agreement, prevail for it. Notices for these components ship with the Software where their licences require it, and you can request the current list, including any source code we are obliged to make available for a third-party component, by emailing [email protected].
8. Term and termination
This Agreement runs until it is terminated. It ends when your right to use the LynxTrac service ends, or if you break its terms. You may end it at any time by uninstalling the Software from your devices. Uninstalling the Agent removes its services from the device; it does not by itself delete the data already in your LynxTrac account. See Delete Your Account & Data for that.
9. Disclaimer of warranties
The Software is provided "as is" and "as available", with no warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that it will run uninterrupted or error-free on every device or configuration.
10. Limitation of liability
We are not liable for indirect or consequential damages, including lost profits, lost data or business interruption. Our total liability under this Agreement is capped at the fees you paid us in the 3 months before the claim arose. Nothing here excludes liability that cannot be excluded by law.
11. Governing law
This Agreement is governed by the laws of India, and disputes are resolved exclusively in Indian courts.
12. Changes to this Agreement
We may update this Agreement. The version published on this page when you install or update the Software applies to that installation. Material changes are announced by email or in the web console.
